Chapter 8 - The Trust Fund Clause

At dawn, Sarah Klein arrived.

Sarah was my college roommate and now one of the most ruthless family law litigators in the state. She walked into Lucy’s room wearing a sharp camel coat, carrying a stack of files that looked like armor.

“I got the will,” Sarah said without preamble, gesturing for Jenna and me to follow her into the private family consultation room down the hall.

She spread several legal documents across the small conference table.

“This is Eleanor Vance’s last will and testament,” Sarah said, pointing to the signature of Arthur’s deceased wife. “Eleanor hated Arthur. Before she died of ovarian cancer six years ago, she restructured the entire family estate. Arthur thought he was the primary trustee. He wasn't.”

Jenna leaned forward. “What did Mom do?”

“Eleanor left the core capital—all twelve million dollars of the commercial real estate portfolio—in an irrevocable dynasty trust for Lucy. Arthur was given a lifetime stipend, but with a fatal condition: if Lucy reaches her twelfth birthday under the primary custody of her biological mother, Arthur’s stipend reduces to zero. The entire estate transfers immediately into a protected trust controlled exclusively by Claire and an independent banking board.”

I stared at Sarah, dumbfounded. “Zero? Arthur would be broke?”

“Worse than broke,” Sarah said. “He’s overleveraged. He took out massive private loans against the expectation of controlling that trust. If he doesn't have legal custody of Lucy by midnight on December thirty-first—six days from now—the banks will foreclose on his estate, his investments will collapse, and he will be completely ruined.”

“That’s why the slippers were wrapped for Christmas,” Jenna realized, covering her mouth. “He couldn't wait. He needed an emergency medical neglect petition filed before the end of the year!”

“Precisely,” Sarah said. “If Claire was arrested or placed under investigation for child endangerment, temporary custody would default to Mark. And Mark, as we know, is Arthur’s puppet. But there’s a catch.”

“What catch?” I asked.

“Mark is Lucy’s father. Under state law, unless Mark voluntarily terminates his parental rights or is convicted of a violent felony against the child, he has equal legal say. Arthur doesn't need to win custody himself. He just needs Mark to file for divorce and demand full temporary custody of Lucy today. And that hearing is scheduled for 2:00 PM this afternoon.”
