Chapter 8 - The Deposition

The formal custody and preliminary injunction hearing took place three weeks later in Courtroom 602 of the Richard J. Daley Center in downtown Chicago.
Judge Evelyn Vance—no relation to Clara, but a jurist notorious for having zero tolerance for domestic violence—sat behind the high wooden bench.
The Harrington side of the courtroom was a study in desolation. Daniel sat next to a court-appointed public defender, wearing an ill-fitting suit he had clearly bought off the rack after his personal accounts were frozen. Linda sat two rows behind him, dressed in high-neck black wool, clutching a designer handkerchief and attempting to project the aura of an ailing, misunderstood saint.
On my side sat Clara Vance, Marcus, and my father. I wore an ivory pantsuit, my hair pulled back neatly, showing the faint trace of the burn scar that still marked my collarbone.
"Your Honor," Daniel’s appointed attorney began, rising nervously to his feet. "My client acknowledges that an unfortunate domestic incident occurred on December twenty-fifth. However, Mr. Harrington was not the aggressor. He is a loving, devoted father who has been completely cut off from his four-year-old daughter for nearly a month. We are requesting immediate restoration of joint legal custody and unsupervised alternating weekend visitation."
Judge Vance adjusted her spectacles, looking down at the paperwork before her. "Mr. Harrington, step to the podium."
Daniel rose, his legs visibly trembling. He gripped the wooden edges of the podium as if he were holding onto a life raft.
"Mr. Harrington," Judge Vance said, her voice dry and piercing. "I have reviewed the transcript of your preliminary deposition taken by Mrs. Harrington’s counsel. In it, you state that you did not see your mother strike your wife. Is that correct?"
"Yes, Your Honor," Daniel lied, his voice squeaking slightly. "The room was crowded. There was a sudden commotion, soup spilled, and by the time I looked up, Sarah was already screaming."
Clara Vance stood up smoothly. "Your Honor, with the court’s permission, we would like to submit Exhibit D into the record."
"Proceed, Ms. Vance."
Clara walked to the clerk’s desk, handing over a digital flash drive.
"On the evening of December twenty-fifth," Clara explained, turning toward Daniel, "Mrs. Linda Harrington hired an elite private catering firm, *L'Étoile Events*, to handle the holiday dinner. What the Harrington family failed to realize is that the catering company utilizes digital body-worn cameras for their serving staff to ensure quality control and inventory management during high-end residential events."
Linda gasped aloud from the gallery.
Daniel’s head snapped toward Clara, his eyes wide with absolute horror.
"We have synchronized footage from two separate servers who were standing directly behind Mr. Daniel Harrington when the incident occurred," Clara said coldly.
The courtroom monitors flickered to life.
The high-definition video was crystal clear. The audio was pristine.
The screen showed the dining table. It captured Linda standing up, her face twisted in rage, screaming at me. It showed me calmly picking up Emma. And then, in sickening, unmistakable clarity, it showed Linda rearing back her right hand and striking me across the face with full force.
It showed the heavy porcelain soup bowl flipping over, pouring boiling-hot broth across my neck and chest. It captured Emma’s piercing, terrified scream.
And then, the camera zoomed slightly as Daniel Harrington sat there, untouched, watching the entire assault.
The audio recorded his exact words, echoing through the silent courtroom:
*"Sarah... you shouldn't have provoked her."*
The video cut off.
A profound, suffocating silence gripped Courtroom 602.
Judge Vance slowly took off her glasses. She looked at Daniel with an expression of such cold, unadulterated contempt that Daniel shrank two inches into his collar.
"Mr. Harrington," Judge Vance said, her voice dropping into a register that made even the court reporter flinch. "You stood before this court not two minutes ago and swore under penalty of perjury that you did not witness this assault."
"Your Honor... I... the shock... I was confused—" Daniel stammered, sweat pouring down his forehead.
"You were not confused, sir," Judge Vance cut in, slamming her gavel down with a sharp, terrifying crack. "You were complicit. You sat by while an innocent child was traumatized and your wife was physically battered. And then you dared to perjure yourself before this bench to shield the woman who committed the crime."
The judge turned her gaze to Linda Harrington in the gallery.
"Bailiff," Judge Vance commanded.
Two armed deputies stepped forward immediately, moving behind Linda’s bench.
"Linda Harrington, you are remanded into custody immediately for violation of your pre-trial release conditions based on newly submitted video evidence of felony domestic battery with injury to a minor's custodian. Bail is revoked."
"What?!" Linda shrieked, springing to her feet. "You cannot arrest me! Daniel! Daniel, do something!"
The deputies didn't hesitate. They twisted Linda’s arms behind her back, the cold steel handcuffs clicking shut over her fragile wrists. Her designer handkerchief fluttered to the floor as she was dragged toward the holding cell door, screaming obscenities that echoed down the marble hallway until the heavy iron door slammed shut.
Judge Vance turned back to Daniel, who looked like he was about to faint onto the carpet.
"As for you, Mr. Harrington," the judge said coldly. "Sole legal and physical custody of the minor child, Emma Harrington, is awarded exclusively to Sarah Bennett. Your visitation rights are suspended indefinitely. You will undergo a comprehensive psychological evaluation, fifty-two weeks of domestic violence perpetrator counseling, and you will pay sixty percent of your future gross earnings in combined child support and legal restitution."
The gavel came down.

"Court is adjourned."
